1. Agreement to these Terms
These Terms of Service (the “Terms”) govern your use of silvercrowstudio.com, Silver Crow Studio’s inquiry and booking pages, and any portrait consultation, session, plate, digital file, or related service you purchase from Silver Crow Studio (collectively, the “Services”). By using the website, submitting an inquiry, booking a session, or making a payment, you agree to these Terms and to any session-specific terms shown to you before booking.
Important: these Terms include a model and media release in Section 9 that authorizes Silver Crow Studio to photograph and record sessions and use the resulting material to advertise and promote the studio. They also include consent to electronic communications, including periodic email newsletters, in Section 12.
If you book for another person, you represent that you have authority to provide their information and accept these Terms on their behalf. If there is a conflict, a written agreement signed by Silver Crow Studio controls, followed by the terms displayed for the particular booking, followed by these Terms.
2. Who may book
You must be at least 18 years old and legally able to enter a contract to create a booking or make a payment. A parent or legal guardian must book and remain responsible for any session involving a minor. By booking a minor, you represent that you are the minor’s parent or legal guardian, have authority to accept these Terms for the minor, and grant the model and media release in Section 9 on the minor’s behalf. Each adult participant must accept these Terms or otherwise authorize the model and media release before participating. The website and online booking service are not directed to children under 13, and children should not submit information through them.
3. Services and booking confirmation
Service descriptions, available times, duration, location, deliverables, and prices are shown on the applicable booking page or confirmed in writing. A time is not reserved until the booking flow confirms it. For a paid booking, confirmation may also depend on successful payment through Stripe. An abandoned or unsuccessful checkout does not create a confirmed booking.
You are responsible for checking the confirmation details and promptly telling us about any error. Availability may change before a booking is confirmed.
4. Prices, taxes, and Stripe payments
Silver Crow Studio is the seller of the photography Services. BusinessStub supplies booking technology but is not the photographer or seller. Paid bookings are processed securely through Silver Crow Studio’s connected Stripe account. Stripe may collect payment and transaction information under its own terms and privacy notice.
The booking page and Stripe checkout will show the amount due and any applicable tax before you pay. By submitting payment, you authorize the charge shown at checkout and represent that you are authorized to use the selected payment method. Unless the booking page expressly says otherwise, prices are in U.S. dollars. Silver Crow Studio does not add a fee merely because you pay online.
We may correct an obvious pricing or description error before performing the affected Service. If we cannot honor a confirmed booking because of such an error, we will offer a reasonable alternative or refund the amount paid for that booking.
5. Cancellations, rescheduling, no-shows, and refunds
The cancellation, rescheduling, no-show, deposit, and refund terms displayed for an appointment before you book are part of these Terms and control for that appointment. Review them before checking the acceptance box and paying. Cancel or reschedule through the secure management link in your confirmation email when that option is available, or contact us at jane@silvercrowstudio.com.
Canceling a booking does not automatically create a refund when the displayed booking policy makes the payment or deposit nonrefundable. If no appointment-specific refund term was displayed, contact us before canceling so we can confirm the available options. Nothing in these Terms limits any nonwaivable refund or cancellation right provided by law.
If Silver Crow Studio cancels a paid session and cannot provide a mutually acceptable replacement date, we will refund the amount paid for the canceled Service. Refund timing after approval depends on Stripe and your financial institution.
6. Arrival, participation, and safety
Please arrive on time and follow reasonable studio, posing, equipment, and safety instructions. Late arrival may shorten the session so later appointments are not disrupted. We may pause or end a session if conduct is unsafe, unlawful, threatening, discriminatory, destructive, or materially disruptive.
Wet-plate photography is a hands-on historical process that uses specialized equipment and chemistry. Clients and guests must not handle studio chemicals or equipment unless Jane expressly invites and supervises them. Tell us before the session about accessibility needs or circumstances that may affect safe participation so we can discuss reasonable arrangements.
Silver Crow Studio uses bright, high-intensity photographic flash during sessions. Flash exposure may not be suitable for every individual, including people with photosensitive epilepsy, migraines, sensory sensitivities, certain medical conditions, or some infants and young children. Tell us before the session if anyone in your party may be sensitive to bright or repeated flashes. You are responsible for deciding whether participation is appropriate for you and any minor in your care and for consulting a qualified medical professional when needed. We may modify, pause, or decline flash photography when we reasonably believe it cannot be used safely.
7. The character of tintype work
Each tintype is made by hand and is a one-of-a-kind photographic object. Plate edges, chemistry marks, tonal variation, contrast, focus, orientation, and other process characteristics can vary. These natural variations are part of the medium and are not defects merely because they differ from a digital preview, reference image, or another plate.
We will use professional judgment and reasonable care, but we do not promise an exact pose, expression, color, tone, or reproduction of another image. If a plate is materially damaged or unusable because of our error before delivery, our remedy may be a reasonable re-sit, replacement attempt, account credit, or refund for the affected item, subject to applicable law and the practical limits of a one-of-a-kind process.
8. Client responsibilities
You are responsible for giving us accurate contact and booking information, obtaining permission from everyone you bring or ask us to photograph, supervising minors and guests in your party, and communicating any time-sensitive request before the session. You may not ask us to create unlawful, infringing, deceptive, abusive, or exploitative material.
9. Physical plates, digital files, copyright, and model release
After full payment and delivery, you own the physical tintype plate or other physical product identified as your deliverable. Ownership of the physical object does not transfer copyright in the photograph.
Unless a separate signed agreement says otherwise, Silver Crow Studio retains copyright in photographs and other creative work it produces. You receive a nonexclusive, nontransferable license to display and reproduce delivered images for personal, noncommercial use. Commercial publication, advertising, resale of image rights, alteration presented as Silver Crow Studio’s work, or licensing to others requires written permission.
Model and media release
By booking, accepting these Terms, or participating in a session, you grant Silver Crow Studio, Jane Carter, and their authorized successors, contractors, and service providers a perpetual, irrevocable, worldwide, royalty-free right and permission to photograph, film, and otherwise record you and the session, including still photographs, the resulting tintype plate and reproductions of it, behind-the-scenes material, video, audio, and your image, likeness, appearance, and voice (collectively, the “Session Media”). If you accept these Terms for a minor, you grant this release for that minor and represent that you are the minor’s parent or legal guardian with authority to do so.
You authorize Silver Crow Studio to select, edit, crop, retouch, adapt, reproduce, publish, display, distribute, transmit, archive, and otherwise use the Session Media, alone or with other material, in any format or medium now known or later developed. Authorized purposes include the studio’s portfolio, website, blog, social media, print and digital advertising, paid advertisements, promotional campaigns, studio publications, displays, exhibitions, competitions, awards, editorial features about the studio, and educational or process demonstrations. Silver Crow Studio may use your first name and a general description of the session with the Session Media but will not publish your contact information or home address.
You understand that Silver Crow Studio owns the copyright in the Session Media, that your session fee and the opportunity to receive the Services are sufficient consideration for this release, and that no additional payment or royalty is due for an authorized use. You waive any right to inspect or approve the finished use and release Silver Crow Studio and the authorized parties above from claims arising from an authorized use, including claims based on rights of privacy or publicity. This release does not authorize a defamatory, unlawful, or materially misleading use of the Session Media.
10. Website content and acceptable use
The website, logos, text, graphics, design, and sample imagery are owned by Silver Crow Studio or used with permission. You may view and share links to the website for personal, lawful purposes. You may not scrape, copy, republish, sell, reverse engineer, interfere with, or misuse the website; bypass security or booking controls; submit false information; test stolen payment credentials; or use automated systems to disrupt the Services.
11. Third-party services and links
The Services may rely on third parties such as BusinessStub, Cloudflare, Stripe, calendar or email providers, and social networks. Their services and websites are governed by their own terms. We are not responsible for third-party websites we do not control, but we remain responsible for our own obligations to you.
12. Electronic communications
By accepting these Terms and providing an email address, you expressly consent to receive electronic communications from Silver Crow Studio. These may include booking confirmations, payment receipts, reminders, schedule changes, replies to inquiries, studio announcements, session availability, special offers, and periodic email newsletters.
You may unsubscribe from marketing emails at any time by using the unsubscribe link in a message or contacting jane@silvercrowstudio.com. Marketing emails will identify Silver Crow Studio, include a valid postal address, and provide a clear way to unsubscribe. After you opt out of marketing, we may still send nonmarketing communications needed to administer a booking, payment, requested Service, safety notice, or legal obligation. This consent does not authorize marketing text messages, autodialed calls, or prerecorded calls; any such communications require separate consent when applicable. Keep your contact information current and do not share private booking-management links.
13. Disclaimers
Except for express promises in these Terms or a written booking agreement, the website and Services are provided on an “as available” basis. To the fullest extent allowed by law, we disclaim implied warranties that may legally be disclaimed. We do not guarantee uninterrupted website availability, a particular artistic or personal reaction, or compatibility with every device or display. These disclaimers do not limit warranties or consumer rights that cannot lawfully be excluded.
14. Limitation of liability
To the fullest extent allowed by law, Silver Crow Studio will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the Services. Our aggregate liability for a claim will not exceed the amount you paid for the Service giving rise to that claim. These limits do not apply where prohibited by law or to liability arising from gross negligence, willful misconduct, fraud, personal injury caused by our negligence, or infringement of rights that cannot be limited.
15. Events outside reasonable control
We are not responsible for delay or inability to perform caused by events outside our reasonable control, such as severe weather, utility or network failure, government action, illness, emergency, venue closure, equipment failure despite reasonable maintenance, or supply interruption. We will communicate reasonably and, when appropriate, offer rescheduling, an alternative, or a refund consistent with the booking-specific terms and applicable law.
16. Governing law and disputes
Idaho law governs these Terms without regard to conflict-of-law rules. Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve the concern. Unless applicable law requires otherwise, claims relating to these Terms or the Services may be brought in the state or federal courts serving Ada County, Idaho. You and Silver Crow Studio each retain any right to bring an eligible matter in small-claims court.
17. Changes, severability, and waiver
We may update these Terms prospectively by posting a revised version and effective date. The Terms in effect when you complete a booking will continue to govern that booking unless a change is required by law or you agree to a replacement. If one provision is unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision is not a waiver.
